Terms of Service · Memory in Grace

1. About these terms

These terms govern your purchase and use of Memory in Grace templates and services ("Products"). By placing an order, you agree to these terms.

2. Provider

Payment processing is handled by Paddle.com Market Limited as the Merchant of Record. Paddle's terms apply to the payment transaction.

3. Products and services

3.1 Templates (instant download)

Each template is a digital file delivered as a Canva-template link plus print-ready PDF. After purchase, you receive a delivery PDF (containing the Canva link) via the success page on our site and via email.

3.2 Done-for-you service

For $119 we hand-design one funeral program for you, delivered as a print-ready PDF within 24 hours of receiving your briefing. Includes up to 2 rounds of revisions.

4. License (templates)

When you purchase a template, you receive a personal, non-exclusive, non-transferable license to use the template for your own funeral or memorial event. You may:

Personalize the template with your details (photos, names, dates, text)
Print as many physical copies as you need for the event and family
Share digital copies with family members for the event

You may NOT:

Resell, redistribute, or sublicense the template
Use the template for commercial design services without a commercial license
Claim authorship of the template design

The template designs themselves remain the intellectual property of Memory in Grace.

5. Right of withdrawal (EU consumers)

For digital downloads delivered immediately, the right of withdrawal under § 356 BGB / EU Consumer Rights Directive expires once download begins, provided you expressly consented at checkout. The Paddle checkout includes this consent.

For our done-for-you service, the right of withdrawal also expires once design work begins (after we receive your briefing), provided you expressly consented to start before the 14-day withdrawal period ends.

7. Delivery

Templates: instantly via the success page after checkout, plus an email confirmation from Paddle.
Done-for-you: within 24 hours of receiving your complete briefing (photo + details).

8. Pricing and payment

All prices are listed in USD. Local taxes (VAT, sales tax, GST) are calculated and added by Paddle at checkout based on your location. You will see the final price before completing payment.

9. Limitation of liability

Memory in Grace's total liability for any claim relating to your purchase is limited to the amount you paid for that specific Product. We are not liable for indirect, incidental, or consequential damages.

This limitation does not apply to liability for intent, gross negligence, injury to life, body or health, or claims under applicable consumer protection laws.

10. Force majeure

We are not liable for delays or non-performance caused by circumstances beyond our reasonable control (technical failures, illness, third-party service outages, etc.). We will inform you promptly and offer alternatives where possible.

11. Governing law and jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for disputes with merchants is Hamburg, Germany. Mandatory consumer protection rights of the customer's country of residence remain unaffected.

12. Changes to these terms

We may update these terms. Changes apply to orders placed after the update date. The current version is always at this URL.
